Waste Collection Waterloo Terms and Conditions

These Terms and Conditions set out the basis on which Waste Collection Waterloo provides waste collection and related services to residential and commercial customers. By making a booking, confirming an order, or allowing our team to collect waste from your premises, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, business, organisation or other entity that requests or receives services from Waste Collection Waterloo.

Services means any waste, rubbish, junk, recycling, clearance or related collection services provided by Waste Collection Waterloo, including but not limited to domestic waste removal, commercial waste collection, bulky item removal and recycling services.

Waste means any materials, goods, items, rubbish or refuse presented by the Customer for collection under the Services, including general waste, recyclable materials and bulky waste, but excluding any prohibited or hazardous waste as described in these Terms and Conditions or under applicable law.

Premises means the property, land, building or location from which the Waste is collected or where Services are delivered.

2. Scope of Services

Waste Collection Waterloo provides scheduled and ad hoc waste collection services within its designated service area. The type and scope of Services will be agreed at the time of booking and may include regular collections, one-off clearances or tailored waste management arrangements.

The Customer is responsible for ensuring that the Services booked are appropriate for the type and volume of Waste to be collected. Waste Collection Waterloo may refuse to collect items that fall outside the agreed scope, exceed vehicle capacity or do not comply with applicable waste regulations.

3. Booking Process

3.1 Bookings may be made by telephone, email or through any booking platform made available by Waste Collection Waterloo. All bookings are subject to availability and confirmation.

3.2 When making a booking, the Customer must provide accurate and complete information, including but not limited to:

a. Full name and contact details.

b. Collection address and relevant access details.

c. Description, approximate quantity and type of Waste to be collected.

d. Preferred date and time window for collection.

3.3 Waste Collection Waterloo will provide an estimated price based on the information supplied. This estimate may be revised if, upon arrival, the Waste type, volume, access or conditions differ materially from the description provided.

3.4 A booking is not considered accepted until Waste Collection Waterloo has confirmed the date, time window and indicative price to the Customer and, where required, received any applicable deposit or pre-payment.

4. Access and Customer Obligations

4.1 The Customer must ensure that safe, lawful and reasonable access to the Premises is available on the agreed collection date. This includes, where applicable, arranging for parking, providing accurate directions, and securing any necessary permissions for our vehicles to access the site.

4.2 Waste must be presented in a manner suitable for collection, for example in bags, containers or loose in an accessible location as agreed at the time of booking. The Customer must ensure that bags and containers are not overfilled, excessively heavy or unsafe to handle.

4.3 The Customer must segregate any waste streams where required by law or by Waste Collection Waterloo, for example separating recyclables from general waste or ensuring that electrical items, bulky objects or special materials are clearly identified.

4.4 The Customer warrants that they either own the Waste presented for collection or have the authority of the owner to arrange for its removal and lawful disposal.

5. Payments and Pricing

5.1 Pricing for Services may be based on one or more of the following: volume of Waste collected, weight, type of Waste, labour time, number of operatives required, vehicle loads, or a fixed fee agreed in advance.

5.2 Unless otherwise agreed, payment is due either in advance of the collection or immediately upon completion of the Service, as notified to the Customer at the time of booking.

5.3 Waste Collection Waterloo accepts payment by the methods advised during booking, which may include card payment, bank transfer or cash where permitted. We reserve the right to request full or partial payment in advance.

5.4 All prices quoted are exclusive of any applicable taxes unless expressly stated otherwise. Any applicable taxes will be added to the invoice at the prevailing rate.

5.5 If the actual volume, weight or type of Waste differs from the Customer's original description, Waste Collection Waterloo may adjust the final price to reflect the work carried out and any additional disposal or labour costs incurred. The Customer will be informed of any price change before additional work is undertaken where reasonably practicable.

5.6 Where payment is not made on the due date, Waste Collection Waterloo reserves the right to charge interest on the overdue amount and to recover all reasonable costs of recovery, including legal and collection agency fees.

6. Cancellations, Rescheduling and Failed Collections

6.1 The Customer may cancel or reschedule a booking by giving reasonable notice to Waste Collection Waterloo. Specific notice periods and any applicable charges will be stated at the time of booking.

6.2 Where a cancellation is made with insufficient notice, Waste Collection Waterloo may charge a cancellation fee to cover administrative costs and any loss of opportunity.

6.3 If our team attends the Premises at the agreed time and is unable to complete the collection due to reasons within the Customer's control, including but not limited to lack of access, incorrect address details, or Waste not being made available, Waste Collection Waterloo may treat the booking as a failed collection and charge a call-out or cancellation fee.

6.4 Waste Collection Waterloo will use reasonable endeavours to attend at the agreed time. However, all times are estimates, and we do not accept liability for delays caused by factors beyond our reasonable control, including traffic, weather or other operational issues. In such circumstances, we will notify the Customer and arrange an alternative time where necessary.

7. Waste Regulations and Prohibited Items

7.1 Waste Collection Waterloo operates in accordance with applicable UK waste management and environmental regulations. All Waste collected is transported and disposed of only at authorised facilities in compliance with relevant legislation and duty of care requirements.

7.2 The Customer must not present any Waste for collection that is classified as hazardous or otherwise restricted under applicable laws, including but not limited to asbestos, certain chemicals, solvents, oils, medical waste, gas cylinders, explosives or radioactive materials, unless expressly agreed in writing in advance and in accordance with specific regulatory requirements.

7.3 The Customer is responsible for informing Waste Collection Waterloo in advance if any Waste to be collected may be hazardous, contaminated, sharp, fragile or otherwise requires special handling. Failure to disclose such information may result in additional charges, refusal to collect the Waste, or termination of the Service.

7.4 If prohibited or hazardous Waste is discovered during the collection, Waste Collection Waterloo may refuse to collect such items, or if already loaded, may take steps necessary to ensure safe handling and legal compliance, including returning items or arranging specialist disposal. Additional charges may apply in such circumstances.

7.5 Once Waste is collected and loaded into our vehicle, title to and responsibility for that Waste passes to Waste Collection Waterloo, except in cases where Waste has been misdescribed, is prohibited, or has been collected based on false or misleading information.

8. Customer Representations and Responsibilities

8.1 The Customer represents and warrants that:

a. All information provided to Waste Collection Waterloo is true, accurate and complete.

b. The Waste presented for collection is lawful to remove, transport and dispose of in the manner contemplated by the Service.

c. The Premises are safe and suitable for our personnel and vehicles to access and operate.

8.2 The Customer agrees to cooperate with Waste Collection Waterloo and to follow any reasonable instructions given in relation to the Service, including instructions about where to place Waste, how to segregate materials and how to maintain safe access.

9. Liability and Limitations

9.1 Waste Collection Waterloo will exercise reasonable care and skill in providing the Services. However, to the fullest extent permitted by law, our liability to the Customer is limited as set out in this section.

9.2 Waste Collection Waterloo is not liable for:

a. Any loss, damage or costs arising from the Customer's failure to provide accurate information or to comply with these Terms and Conditions.

b. Any indirect, consequential or economic loss, including loss of profit, business, contracts, goodwill or anticipated savings.

c. Any delay or failure in performance caused by events beyond our reasonable control, including but not limited to adverse weather, traffic congestion, mechanical breakdown, industrial action or emergency incidents.

9.3 While our team will take reasonable care when operating at the Premises, the Customer is responsible for protecting driveways, paths, fixtures, fittings and surfaces that may be susceptible to damage from vehicles or movement of Waste. Waste Collection Waterloo is not liable for cosmetic damage to surfaces where reasonable care has been taken.

9.4 Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

9.5 Subject to the above, the total aggregate liability of Waste Collection Waterloo to the Customer arising out of or in connection with any Service, whether in contract, tort or otherwise, shall not exceed the total amount paid or payable by the Customer for that specific Service.

10. Indemnity

The Customer agrees to indemnify and keep indemnified Waste Collection Waterloo from and against all claims, losses, damages, costs, expenses and liabilities (including reasonable legal fees) arising out of or in connection with:

a. The Customer's breach of these Terms and Conditions.

b. The Customer's failure to comply with applicable waste regulations.

c. The presentation of prohibited, misdescribed or hazardous Waste for collection without prior disclosure and agreement.

11. Data Protection and Privacy

Waste Collection Waterloo collects and processes personal data necessary to provide the Services, manage bookings, process payments and communicate with Customers. Personal data will be handled in accordance with applicable data protection laws in the UK. By using our Services, the Customer consents to such processing as is reasonably necessary for the performance of the contract and related purposes.

12. Complaints and Dispute Resolution

12.1 If the Customer is dissatisfied with any aspect of the Services, they should contact Waste Collection Waterloo as soon as possible, providing full details of the issue.

12.2 We will investigate complaints in a timely and fair manner and, where appropriate, seek to resolve matters by providing an explanation, corrective action or other reasonable remedy.

12.3 If a dispute cannot be resolved directly between the parties, either party may consider seeking independent advice or using alternative dispute resolution processes where available.

13. Variations to the Terms

Waste Collection Waterloo may update or amend these Terms and Conditions from time to time to reflect operational changes, legal requirements or improvements to our Services. The version in force at the time of booking or Service provision will apply to that particular Service. Customers are encouraged to review the current Terms and Conditions when making a booking.

14. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision will be severed from the remaining provisions, which will continue to be valid and enforceable to the fullest extent permitted by law.

15. Assignment

The Customer may not assign, transfer or subcontract any of their rights or obligations under these Terms and Conditions without the prior written consent of Waste Collection Waterloo. Waste Collection Waterloo may assign or subcontract its rights and obligations where necessary for operational reasons, provided that this does not materially affect the Service provided to the Customer.

16. Entire Agreement

These Terms and Conditions, together with any written Service description or confirmed quotation, constitute the entire agreement between Waste Collection Waterloo and the Customer in relation to the Services and supersede any prior understandings, agreements or representations, whether oral or written.

17. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.
